CONTEST RULES AND REGULATIONS

ROGERS FASTEST SERVE CONTEST - 2009

The Rogers Fastest Serve Contest 2009 (the "contest") is open to residents of Ontario who are 18 years and older, excluding employees of the Contest Sponsor, Rogers Communications Inc. ("Rogers"), its parent and affiliated companies, representatives, dealers and agents, contest suppliers and judges, and those with whom they are domiciled. The contest is subject to all applicable federal, provincial and municipal laws and regulations.

  1. The Contest Period starts on Saturday August 15, 2009 and continues until 2:00 pm on Sunday August 31, 2008, the Contest Closing Date. All Times are Eastern Times. No Purchase Necessary.

  2. To enter, do any or a combination of the following before the Contest Closing Date:

    1. Go to www.rogerscup.com/rogers, complete the online entry ballot in full and submit as instructed along with the name of the tennis player who you think will clock the fastest serve during the 2009 Rogers Cup in Toronto. Limit of one (1) entry per person per day during the Contest Period. Any attempt or suspected attempt to submit a greater number of entries, any use of robotic, automatic, programmed methods or entry methods not authorized by these rules, shall be deemed as tampering and will void all of your entries.
    2. Send a text message containing the name of the tennis player who you think will clock the fastest serve during the 2009 Rogers Cup in Toronto, using your Rogers Wireless device to short-code 4997 before the Contest Closing Date. Text messaging charges of $0.15 per message sent or according to your price plan will apply.

    Among all online or text received by the Contest Closing Date, only the entries containing the name of the tennis player having clocked the fastest serve during the 2009 Rogers Cup in Toronto will be entered in the contest draw.

  3. PRIZES. Entrants are eligible to win one (1) of the following:

    1. Grand Prize: one (1) Rogers Cup Fantasy weekend package for two consisting of two (2) tickets to attend the 2010 Rogers Cup finals in Montreal OR in Toronto, at the winner’s choice, a chance to meet the Rogers Cup champion (subject to the availability of the player), a Tennis lesson, Rogers Cup autographed merchandise along with two (2) nights’ hotel accommodation (double occupancy) and return travel to / from the closest major city in where winner resides to Toronto or Montreal (unless winner’s residence, as determined by Contest Sponsors, is within at least three (3) hours driving distance of the Rogers Cup location, in which case transportation by train or limousine will be provided), ground transportation to and from the airport as may be required.

      Approximate retail value of the prize is of $1,000. Actual prize value depends on location of winner’s residence and flight schedule (as may be required). No financial compensation will be made when or if value is different to approximate retail value of prize.

      Due to the nature of the promotional prizing, no alternate travel dates or tickets to the Rogers Cup tennis session are available to those defined by the Contest Sponsors. Winner and travel companion must travel together. Winner and travel companion are solely responsible for ground transportation, taxes, transfers, travel insurance, meals, spending money, tips, and other travel and hotel charges not specifically mentioned as part of the prize. Winner and travel companion are solely responsible for obtaining their own travel documents as may required in advance of the departure date. Trip must be completed on the dates specified by the Contest Sponsors, according to date of the selected Rogers Cup event. Flight and accommodation will not be rescheduled once booked.

    2. Secondary Prize: One (1) year of Rogers Hi-Speed Express internet service having a total approximate retail value of $600 and including the rental of a cable modem. Rogers Cable may not be available in all areas. Selected entrant not residing in a Rogers Cable ready area will eligible to win in lieu of the Rogers Cable portion of the prize, a $100 Gift Card redeemable at Rogers Plus. This prize will only be made available to winners not residing in a Rogers Cable ready area. In the event selected entrant lives in a Rogers Cable ready area but declines the Rogers Hi-Speed Internet, Secondary prize will then be forfeited and no substitution (in cash or otherwise) will be awarded to that entrant.

  4. Random Draw

    A random draw from all entrants having correctly answered which tennis player had the fastest serve during the 2009 Rogers Cup in Toronto will be made at approximately 4:00 pm on Tuesday September 1, 2009 at the offices of Rogers at One Mount Pleasant, 4th Floor, Toronto, Ontario, M4W 2Y5 by a representative of the Contest Sponsor. The first entrant selected will be deemed to be the selected entrant for the Grand Prize, and the next entrant selected will be the selected entrant for the Secondary Prize. Selected entrants will be contacted by telephone as set out on the entry form.

    If a selected entrant cannot be reached within seven (7) business days following the first attempt of contact, incorrectly answers the skill-testing question, declines the prize, or fails to return a Release of Liability as specified by the Contest Sponsor, Contest Sponsor reserves the right, at its sole discretion, to select another entrant or to cancel the prize.

  5. To be declared a winner, selected entrants must first correctly answer, unaided, a time-limited, mathematical skill-testing question posed by telephone at a mutually convenient time. Winners and guests must return a signed release of liability and acknowledgment form as required by the Contest Sponsor. Contest judges' rulings are final and without appeal in all matters related to the promotion and the awarding of prizes. The contest is subject to all applicable federal, provincial and municipal laws and regulations.

  6. By entering this Contest, entrants consent to the use of their entry, name, city of residence and/or any photograph of or that may be taken in publicity carried out by the Contest Sponsor and/or its advertising agencies, without further notice or compensation.

  7. No communications will be entered into except with selected entrants.

  8. Odds of winning depend on the number of eligible entries received in the draw. All entries that are incomplete, illegible, damaged, irregular, abusive, or have been submitted through illicit means or using any method that artificially increases odds of winning, or do not conform to or satisfy any condition of the rules may be disqualified by the Contest Sponsor, without further notice at their sole discretion. Contest Sponsor takes no responsibility for lost, stolen, delayed, damaged, misdirected, late or destroyed entries, or for typographical or other production errors. Contest Sponsor is not responsible for any errors or omissions in printing or advertising this Contest.

  9. Rogers is collecting personal data about entrants for the purpose of administering this Contest. No further informational or marketing communications will be received by entrants unless entrants provide Rogers with explicit permission to do. Please see Rogers’ Privacy Policy at www.rogers.com for information on their policy towards maintaining the privacy and security of user information.

  10. By entering this Contest, entrants release and hold harmless the Contest Sponsor, its respective advertising and promotional agencies, and the contest judge(s), their affiliates and respective directors, officers, owners, partners, employees, agents, dealers, representatives, successors and assigns from any liability in connection with this Contest or, if declared a winner, the prize(s) awarded and use thereof. Without limitation to the standard terms and conditions associated with use of the tickets awarded, the winner (a) releases Contest Sponsor, its affiliates and respective directors, officers, owners, partners, employees, agents, dealers, representatives, successors and assigns from any and all liability resulting from any incident related to the tournament; (b) acknowledges that management of the tournament reserves the right to refuse admission and/or to expel from the premises any person whose presence or conduct is deemed by it to be objectionable, expulsion cancels the ticket(s) to the game and the holder thereupon forfeits all claims, including any claim to refund, tickets which are or are deemed to be lost or stolen will not be honoured; and, admission to all games is subject to compliance with all applicable laws, by-laws, regulations and facility rules; failure to comply may result in non-admission or expulsion. Before being declared a winner, entrants may be required to sign and return, within a stipulated period of time, a Declaration of Compliance with the Contest Rules and a full Liability and Publicity Release. By accepting a prize, winners consent to the use of their name, place of residence, voice, statements, and photographs or other likenesses for publicity, advertising or informational purposes in any medium or format without further compensation or notice.

  11. This Contest will be run in accordance with these rules, subject to amendment by the Contest Sponsor. Contestants must comply with these rules, and will be deemed to have received and understood the rules by participating in the Contest. The terms of this Contest, as set out in these rules, are not subject to amendment or counter-offer, except as set out herein.

  12. Contest Sponsor assumes no responsibility for failure of the internet or the website during the promotional period, for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, access providers, computer equipment, software, failure of any email or traffic congestion on the internet or at any website, or any combination thereof including any injury or damage to an entrant’s or any other person’s computer related to or resulting from playing or downloading any material in the promotion.

  13. Contest Sponsor reserves the right, in their sole discretion, to cancel or suspend this Contest, or any portion thereof, should the games for which the Grand Prize is awarded be cancelled, or should a virus, bug or other cause beyond their reasonable control corrupt the security or proper administration of the Contest. Any attempt to deliberately damage any web site or to undermine the legitimate operation of this promotion is a violation of criminal and civil laws. Should such an attempt be made, Rogers reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution

  14. If the identity of an entrant is disputed, the authorized account holder of the Rogers Wireless account or of the e-mail address submitted at the time of entry will be deemed to be the entrant. The individual assigned to the Rogers Wireless account or the e-mail address for the domain associated with the submitted e-mail address is considered the authorized account holder. A selected entrant may be required to provide proof of being the authorized account holder of the Rogers Wireless account or the e-mail address associated with the selected entry. All entries must be submitted from a valid Rogers Wireless account or e-mail account. The sole determinant of time for the purposes of receipt of a valid entry in this contest will be the contest server machine(s).
